Terms of Service

1. Acceptance of Terms
By using the services provided by TKO HEB, LLC (referred to as "we," "us," or "our"), you agree to comply with and be bound by these Terms of Service (referred to as "TOS"). If you do not agree to these TOS, please do not use our services.
2. Service Description

Customers can schedule appointments online, over the phone, or in person. We strive to offer transparent pricing and high-quality workmanship with a focus on delivering exceptional customer service. By opting into our services, customers may receive updates via email, text messages, and phone calls regarding their appointments and service status. Clients can opt-out of receiving these communications at any time.
3. Communication Consent
By providing your contact information to us, you consent to receive text messages and emails from us regarding promotions, marketing ideas and best practices, notifications for enhancements to our software, and other various industry information. You also acknowledge that message and data rates may apply, and you are responsible for any associated costs.
4. SMS Terms and Conditions
We may send promotional and transactional mobile messages in various formats. Promotional messages may include special offers, incentives, and live event reminders. Transactional messages may include reminder text messages about your appointment, scheduled customer service calls, or other reasons you may need to communicate with us.
- Message frequency – you may receive up to 10 SMS messages per month

- How to opt out – to stop receiving SMS (text) messages, reply 'Stop' or 'End' to any SMS message received from us or email us at cmartin@longhornnissan.com with your full name and the mobile phone number used to text message you. We will respond as soon as we update your records to stop receiving text messages.

5. Privacy and Data Protection
We respect your privacy and will handle your personal information in accordance with our Privacy Policy. By using our services, you agree to the collection, use, and disclosure of your information as described in our Privacy Policy.
6. Opt-In and Opt-Out
User Opt-in: By providing your mobile phone number to us, you are voluntarily opting in to the Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal "Do Not Call" list. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at cmartin@longhornnissan.com
User Opt-out: You may opt-out of the Program at any time. If you wish to opt-out of the Program and stop receiving mobile messages from us, or you no longer agree to these Terms of Service, reply "Stop" or "Quit", and/or "Unsubscribe" to any mobile message from us. You may continue to receive text messages for a short period while we process your request, and you may receive a one-time opt-out confirmation message. You understand and agree the foregoing is the only reasonable method for opting out. For support, reply 'HELP' to any mobile message from us.
Our mobile messaging platform may not recognize requests modifying the foregoing commands, and you agree we and our service providers will not be liable for failing to honor requests which do not comply with the requirements in these Mobile Messaging Terms. We may also change the telephone number or short code we use, and we will notify you of any such change. You acknowledge any requests sent to a telephone number or short code which has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number or short code which has been changed.
7. User Responsibilities
You agree to:
- Provide accurate and up-to-date contact information.
- Not use our services for any unlawful, fraudulent, or malicious purposes.
- Abide by all applicable laws and regulations when using our services.
8. Limitations of Liability
We make no warranties or guarantees regarding the accuracy, completeness, or availability of the information we provide. We are not responsible for any actions or decisions made based on the information we convey. Information provided by a customer using our software is accurate based on the customer's input and we are not held liable for its accuracy. Transactions between us and customers are exclusive of third parties.
9. Termination
We reserve the right to terminate or suspend your access to our services at our discretion, without notice, if you violate these TOS or engage in any harmful activities.
10. Cancellation
All of our subscriptions are no-contract and clients are free to cancel with a minimum of 30 days notice from their next billing date. Prior to cancellation it is your responsibility to ensure all media assets, customer lists, configured features (templates, workflows etc.), funnels, websites, and phone numbers are transferred or removed from service.
Once your cancellation is processed this is irreversible and all data within the system will be purged including any phone numbers purchased through the system, social media advertisement assets (images, designs, etc.), landing pages, funnels, website, CRM records, and previous correspondence with customers via text, email, facebook messenger, etc. If you'd like to transfer out any actively used phone numbers it will be your responsibility to submit the porting request to cmartin@longhornnissan.com to do so.
In lieu of cancelling your subscription permanently, you may opt to suspend your billing for a short specified period-of-time after which point we will be able to resume your account. During this time all access, communications (Phone/SMS/Email), websites, automations, and other services will be paused. You will be responsible for the direct maintenance fees of phone numbers charged by the carrier however they will not be terminated/released. All functions and billing will automatically resume after the specified period-of-time. Suspensions are limited to 90-day spans after which billing will resume for a minimum of 30 days.
11. Intellectual Property
The forms, campaign content, website images, messaging, video clips, audio clips, and other marketing materials contain proprietary information and material that is owned by TKO HEB, LLC and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use with TKO HEB, LLC in compliance with this Agreement. No portion of these Services may be reproduced in any form or by any means without expressed written permission from TKO HEB, LLC.
12. Changes to Terms
We may update these TOS from time to time. It is your responsibility to review these terms periodically. Continued use of our services after any changes indicates your acceptance of the updated terms.

14. Governing Law
This Terms of Service is governed by and construed in accordance with the laws of Texas, without regard to its conflict of law principles. By using our services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
